Responding to the Freedom Industries chemical spill
S.B. 373, the bill introduced by Senator John Unger to regulate aboveground storage tanks, passed out of the Senate today. The bill had previously been amended in the Senate Judiciary Committee to include a lot of the language proposed in the Governor’s bill.
We have already posted on the limitations of these regulations, which focus narrowly on aboveground storage tanks (with many exemptions); don’t provide sufficient funding to the DEP to adequately enforce the regulations; and leave much of the details to the DEP rule-making process, which tends to happen outside the public eye.
Now the bill will move through committees in the House of Delegates, where we will have another chance to amend some of the recommendations of Downstream Strategies and the West Virginia Rivers Coalition into the bill. See our “Take Action” page (scroll down to #3) for details.
